by commissioning me or bidding and/or buying my adoptables, you agree to all of the terms below:
ADOPTABLES
~ Not necessarily FCFS – first to be able to pay has priority (upfront payment > holds or payment plans). I will prioritize commercial usage over personal usage if the money hasn’t been sent yet!- If you already have pending money owed, you must pay the owed amount before making any new purchase, OR pay for both in full at payment date/add the new amount to each owed amount, if payment plan. This applies both to my commissions and adoptables.~ If you do a chargeback after purchasing, your ownership of the design will be revoked and I am allowed to use it for any other purposes, such as for resales.~ By violating my TOS, backing out and/or while being the highest bidder you will be put on my blacklist. Two strikes and you’re in (2nd strike = blacklist). Some offenses can immediately be put in blacklist (such as chargeback, ghosting, refusing to pay, etc).~ Do not edit/delete/back out on your bid! Please only bid if you are 100% sure you want the design and are able to pay the amount!~ If there is no payment within 24hrs without a valid reason, the adoptable will be automatically considered as “canceled” and I will go to the 2nd highest bidder/2nd in line.~ I usually delete the art after 1 day-2 weeks from final delivery to clear my storage and prevent lags, so please ensure that everything you need has been delivered within this time period.~ Commercial usage is always included in the highest AB/SP. During auctions, it will be included once a certain amount has been reached. Commercial fee may be purchased at a later date.~ Payment plans are accepted for bids over $100 and can extend for a period of 2 weeks - 1 month depending on the amount. However, there should be a certain amount of downpayment within the first 24 hours. For payment plans, I will ask you to fill out a form which you must follow.~ I can do holds for up to 2 weeks. However, please note that if there are more than 1 person interested, I will prioritize upfront payments. I can extend holds if there is only one person interested!~ If you have a privatted design of mine, please make sure I'm authorized and able to access it since I do like to keep in track of my adopts. This only applies to Toyhouse users - if you need a code so I can transfer an adopt to you, feel free to ask.~ English is not my first language, so sometimes I might have difficulty understanding requests or modifications. I ask you to be patient with me please!~ No refund (including down payment) will be given, no matter the reason.~ Payment is via Paypal or Kofi. There is a 4% paypal conversion fee added to the final price. I will send you a Drive link with all the files after I have received the entirety of the money. You will have full ownership after the full payment. Do not claim for it to be yours if you haven’t paid in its entirety.~ All adoptable designs and prices are final. This means I will not edit the adopt after purchase, but feel free to do so yourself. However, it is possible to do small edits (such as eye color change or small changes). Note this is because all layers are merged together at sale.~ When applied, please credit me for the design. Redesign/reselling/trade/gifting is okay but not at a higher price than bought, unless extra art or add-ons has been bought. However, the price should be reasonable and more or less match each additionnal value. If redesigning or editing, it should look somewhat similar to the original adoptable; please keep a copy of the original version somewhere, in case of trade/resell. Adoptable can be used as a new outfit or alternate outfit for a pre-existing OC. It can also be used as Vtuber if the commercial fee has been paid.~ I have the right to post the work on any of my platforms or to self-promote the piece.~ Clients cannot claim to have made the art, design, use it for AI, use it for NFT or similar, use it for commercial without paying the commercial fee, etc.~ If you have any other questions, feel free to ask!!
GENERAL

You will not be affected by the new update if you have requested before the update, but will in the future. by requesting a commission, you agree and have read all of the following:~ If there is no response within 24hrs without a valid reason, the commission will be automatically considered as “canceled” (no refund). This will only apply if I am the one to initiate the conversation (ex. a question abt the OC, detail, price, etc., update on the cms, etc.) - in other words pls answer within a day, & if you know you sometimes cannot answer within this period let me know beforehand - if not I will automatically assume you are not interested for xyz reasons.~ I sometimes livestream my commission work (therefore wips) on Discord. Please let me know if you’d like the work to be private (+fee).~ You can cancel the commission at any stage before lineart, but by doing so (or by backing out, unagreed chargeback, not paying and dipping, etc) you agree that I am allowed to use the scrap as a YCH, adopt, sale, etc or for other purposes. I do not offer refunds for canceling.~ The commission request can be declined if I am uncomfortable or feel like I may not deliver the commission well enough. I am allowed to refuse, with or without reason.~ Refunds can only be given if I am unable to finish the commission. Otherwise, no refund will be given, no matter the reason.~ Payment is via Paypal or Kofi. Full payment either upfront, or at approval of the sketch. For skeb style: upfront only. There is a 4% paypal conversion fee added to the final price. I'll let you know which options I can do.~ Deadline may vary depending on the request and, most of all, my motivation, so I ask you to be patient with me. It can take me anywhere between 1 day-3 months to complete, though it may vary depending on the commission type & my circumstances, and can be more or less. I mostly work on commissions during the weekend as I am a student, so there is slow progress, please don't ask for updates every few days or rush me unless I haven't sent you anything for 2.5-3+ weeks ! thank you for your understanding ^^~ Small correction changes purposes can be applied after sent work, if skeb style. If not, changes can be applied whenever (no major changes after sketch - extra fee if so, unless a mistake from my part)~ The client can use the piece for anything non-commercial (printing it for personal use, using it as a reference for future use/other people, etc). Otherwise, if commercial = double the price, or additional TBD fee.~ Commercial usage includes promotional art, cover, streaming graphic (loading screen, etc.), merch, vtuber reference sheets that will be used as reference for commercial related purposes – basically anything that you'll be directly using for the purpose of gaining $. If you are not sure, you can let me know & I will tell you whether it is or not.~ Clients cannot resell the piece, claiming to have made the art, use it for AI, use for NFT or similar, use it for commercial without paying the commercial or royalty fee, etc.Add 🎀 anywhere in the form to confirm you read and accept everything. I will still accept if you don’t, but it will be proof that if anything happens that was stated in my TOS, it will not be my fault.
